Article 2 These Measures shall apply to the management of outdoor lighting environment in Jiang'an, Jianghan, Khankou, Hanyang, Wuchang, Qingshan and Hongshan Districts of this Municipality.
The management of the outdoor lighting environment in the towns where the people's governments of other districts are located shall be implemented with reference to these Measures.
Article 3 The urban outdoor lighting environment referred to in these Measures refers to outdoor lighting that beautifies and decorates the city's night scene, including:
(1) Lighting fixtures installed in public places such as urban roads, bridges, and large-scale parks;
(2) Outdoor advertising lighting;
(3) Lighting fixtures such as contour lights, projection lights and neon lights provided by the building (structure);
(4) Lighting of the name of the unit, signage, window, etc. set by the main roads and main passages along the street organs, groups, enterprises and institutions, and individual operators.
Article 4 The municipal, district, city, and environmental health administrative departments shall be responsible for the supervision and management of the installation and use of outdoor lighting in their respective jurisdictions in accordance with their respective duties.
The departments of planning, municipal administration, power supply, premises, gardens, industry and commerce, and public security shall, in accordance with their respective responsibilities, coordinate with the administrative department of city appearance and environmental sanitation to do the relevant management of urban outdoor lighting installation and use.
Article 5 The urban outdoor lighting construction plan of this Municipality shall be prepared by the municipal city appearance and environmental sanitation administrative department in conjunction with the municipal planning department, and shall be organized and implemented after being reported to the Municipal People's Government for approval.
Article 6 The outdoor advertising lighting is set by the advertising publisher. The other outdoor lighting is set by the management unit or the user unit, and the individual operator is responsible for setting up the individual operator.
Urban outdoor lighting shall be set according to the location, form and time limit stipulated by the municipal, district, city and city environmental and environmental administrative departments.
Article 7 The setting of urban outdoor lighting shall adopt new technologies, new materials, new light sources and new techniques to achieve beautiful, clean and safe, and shall not affect the city appearance, obstruct the traffic and fire exits, and shall not affect the functions of urban public facilities, and shall not affect the construction. (structure) safety.
Article 8 The size and signboard of outdoor advertising and commercial door points shall be set in the form of neon lights, light boxes and electronic display screens.
Article 9 The outdoor lighting of large and medium-sized buildings (structures) to be built and under construction shall be designed, constructed and put into use simultaneously with the main project construction.
The urban outdoor lighting construction project was completed and the city appearance and environmental sanitation administrative department organized a special inspection and acceptance.
Article 10 Urban outdoor lighting shall be kept in good condition and function, and the user shall be responsible for maintenance and management. Changes, movements, and dismantling of urban outdoor lighting shall be reported to the municipal and municipal environmental administrative department for approval.
It is forbidden to damage urban outdoor lighting facilities.
Article 11 The outdoor lighting and the lighting of the building (construction) of public roads and bridges (including overpasses and pedestrian bridges), stations, wharfs, squares, etc. must be opened and closed at the same time as the street lamps.
Outdoor lighting other than those specified in the preceding paragraph shall be opened at the same time as the street light, and the closing time shall not be earlier than 23:00.
Article 12 The electricity used for non-operating outdoor lighting shall be examined and approved by the municipal city appearance and environmental sanitation administrative department, and the certificate shall be issued by the construction unit to the power supply department, and the electricity price shall be paid according to the street lamp lighting price.
Article 13 The municipal, district, city, and city environmental administrative departments shall strengthen the supervision and management of the setting and use of outdoor lighting. For those who do not set up or use urban outdoor lighting in accordance with the provisions of these Measures, they shall be ordered to make corrections within a time limit. Those who fail to make corrections within the time limit may be given a warning or a fine of not less than 500 yuan but not more than 1,000 yuan; if they are in violation of the provisions of these Measures, they may be fined up to 3,000 yuan.
The penalties in the preceding paragraph shall be implemented by the city appearance and environmental sanitation administrative department or the city appearance environmental sanitation supervision agency entrusted by it.
Article 14: If the city's outdoor lighting is damaged, it shall be liable for compensation according to law; if it constitutes a violation of public security management, the public security department shall impose penalties in accordance with the Regulations of the People's Republic of China on Public Security Administration Punishment; if it constitutes a crime, it shall be brought to justice by the judicial organs. responsibility.
Article 15 The specific application problems of these Measures shall be interpreted by the municipal competent department of city appearance and environmental sanitation.
Article 16 These Measures shall be implemented as of the date of promulgation.
